BlueHive Health, LLC. (“BlueHive”, “Us” or “We”) respects your privacy and we are committed to protecting it through our compliance with this Privacy Policy.

This Privacy Policy describes the types of information we may collect from you or others through the website www.BlueHive.com (the “Website”) or the BlueHive mobile or desktop applications (collectively, the “App”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. This Privacy Policy applies to information we collect on the Website, the App and in email, text, and other electronic messages between you and the Website or the App. It does not apply to information collected by us offline or through any other means, including on any other website or application operated by BlueHive or any third party.

If you do not agree with our Privacy Policy, your choice is not to use our Website and the App on behalf of yourself or your employer. By accessing or using the Website or the App, you agree to this Privacy Policy. If you are accessing the Website and App on behalf of your employer or someone else, you represent that you are authorized by such entity or individual to agree to this Privacy Policy.

In addition to this Privacy Policy, your use of the Website and App is at all times subject to the Agreement (as is defined in our Terms of Use https://bluehive.com/terms-and-conditions), which incorporates this Privacy Policy. Any terms not defined in this Privacy Policy are defined in the Terms of Use.

1. Information We Collect About You and How We Collect It

The Website and App may be accessed without a BlueHive account. To benefit from all of the Services we offer, however, it may be necessary to create a BlueHive account and provide certain information to BlueHive. We collect several types of information from and about users of our Website and App.

Information You, Your Employer or Your Occupational Health Provider Provide to Us: The information we collect on or through our Website and App may include:

  • Contact information about you, such as your name, postal address, e-mail address, telephone number;
  • Information about your employer;
  • Demographic information, such as your birthdate, gender and zip code;
  • Medical data related to your occupational health status as well work-related medical monitoring and surveillance, which may include protected health information;
  • Records and copies of correspondence;
  • Details of transactions that you, your occupational health provider or your employer carry out through our Website and App, such as the booking of appointments with occupational health providers and/or payment for services; and,
  • Other information that you may share with us, including information shared at the time of registration, such as passwords and user accounts.

We may also collect other additional information as entered by you or others. You also may provide information to be published or displayed on public areas of the Website or App, or transmitted to other users of the Website, App or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website or App with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Website and App and its Content to you, including the Database, and allow you to participate in any interactive features.
  • To allow you to utilize the Services and the Content for the Permitted Uses.
  • To fulfill any other purpose for which you consent or which are described to you.
  • To provide you with notices about your account.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us as well as us and third parties, including for payment processing and scheduling appointments.
  • To notify you about changes to our Website, the Content, the Services, the Permitted Uses or any other services we offer or provide though it.
  • To fulfill our legal obligations, including to prevent, detect and protect against security incidents, prohibited activities, and illegal or fraudulent activities.

  • To employers, occupational health providers, contractors, service providers, and other third parties that utilize our Website and App and who are bound by contractual or legal obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them or for which you consent.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of BlueHive’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by BlueHive about our Website users is among the assets transferred.
  • To fulfill the purpose for which you provide it. For example, if you provide us with information relevant to your occupational health status or that of your employee’s occupational health status, we may utilize it for the purpose for which it was provided.
  • For any other purpose disclosed by us when you provide the information or consented to by you.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To perform operational functions, such as hosting, billing, security, analytics and other functions related to the Website and the App.
  • To protect BlueHive and its users and to enforce the Agreement with you and others.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of BlueHive, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

4. Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

5. Accessing and Correcting Your Information

You can review and change the personal information entered by you by logging into the Website and visiting your account profile page. Note that you may not be able to change the personal information entered by your employer or an occupational health provider. Any amendment to the information entered by your employer or occupational health provider should be addressed directly with your employer and/or occupational health provider. BlueHive has no control over the content of information entered by your employer or occupational health provider.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users.

6. Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We have implemented industry standard measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored in the United States of America and on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or App, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure.
